The Department of Justice and Education’s Civil Rights Division told schools that transgender bathrooms needed to be implemented into public schools. According to that guidance, no student would be asked to “prove” or otherwise document their gender identity; adherence to Title IX was ” a condition of receiving Federal funds.”
Title IX states that: No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.
President Obama didn’t personally issue the guidance; no students would be forced under its provisions to share bathrooms or locker rooms. President Obama decided and released a directive stating public schools must allow transgenders to use the bathroom of their choice. Texas says no thanks and is accusing Obama of blackmail. What President Obama and his Attorney General don’t seem to know is that transgender restrooms are a 10th Amendment issue, it’s left up to the states to decide how to handle it. The federal government has no jurisdiction in this matter at all.
The U.S. Department of Education Office of Civil Rights and the U.S. Department of Justice Civil Rights Division issued a joint letter [PDF] that included “significant guidance” on 13 May 2016. The letter detailed federal guidelines for transgender students and bathroom.
